Closing the Loopholes

 

The Australian Federal Government has proposed changes to employment laws in the new “Closing the Loopholes” bill thereby significantly altering the definition of casual employment in Australia. The basis of casual employment is changing – not just on actual work patterns, and not just job titles, but also in respect to job security and benefits.

Brad Dodemond of People Partners HR will  address our August Breakfast and explain what you need to know about these changes, how they may affect your staffing plans and when they are likely to come into effect.

Brad’s extensive presentation will cover areas of the new bill and their impact including the following:-

Substance Over Form

  • Substance over form means the actual nature of the working relationship.
  • Work Patterns: Are the hours regular and predictable?
  • Job Expectations: Is there an ongoing expectation of work?
  • Employment Arrangements:Is a job a permanent job rather than casual?

 For employers, this means:

  • Reviewing current employee statuses.
  • Possibly converting some employment positions.
  • Keeping detailed compliance records.

For employees, this means:
Protection for workers from indefinite casual roles.

Possibly gaining greater job security and benefits.

How and when to Prepare

  • Stay informed about the new laws.
  • Review and update employment contracts.
  • Consider consulting HR experts such as People Partners HR to ensure compliance.

The new definition of casual employment aims to make work more secure and fairer for employees, while presenting new challenges for employers. By understanding these changes and preparing accordingly, Australian businesses can ensure they remain legally compliant and hopefully foster a better work environment.
